General Information

The following information provides a simple overview of what happens to your personal data when you visit our website. Personal data is any data that can be used to personally identify you. Detailed information can be found in the following sections.

Data Collection on Our Website

Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. You can find their contact details in the section “Information on the responsible party” as well as in the legal notice (Impressum).

How do we collect your data?
Your data is collected, on the one hand, by you providing it to us, e.g., via a contact form or when booking a course. Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data (e.g., internet browser, operating system, or time of page access).

What do we use your data for?
Part of the data is collected to ensure the error-free provision of the website. Other data is used for the processing of contracts (e.g., course bookings). Data for the analysis of your user behavior is only collected with your consent.

What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipient, and purpose of your stored personal data. You also have a right to correction, deletion, or restriction of the processing of this data, as well as the right to data portability. If you have given consent, you can revoke it at any time with effect for the future. Furthermore, you have a right of appeal to the competent supervisory authority. For this purpose, as well as for further questions on the subject of data protection, you can contact us at any time.

2. Hosting

We host the content of our website with the following provider:

STRATO GmbH
Otto-Ostrowski-Straße 7
10249 Berlin

Details can be found in the privacy policy of STRATO: https://www.strato.de/datenschutz/.

The personal data collected on this website is stored on the host’s servers. This may primarily involve IP addresses, contact requests, meta and communication data, contract data, contact details, names, website access, and other data generated via a website.

The use of the host is in the interest of a secure, fast, and efficient provision of our online offer (Art. 6 para. 1 lit. f GDPR) and for the fulfillment of contracts with our customers (Art. 6 para. 1 lit. b GDPR). Our host processes your data only to the extent necessary to fulfill its performance obligations and follows our instructions.

Data Processing Agreement
We have concluded a data processing agreement (DPA) with the host in accordance with Art. 28 GDPR.

3. General Notes and Mandatory Information

Data Protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

We point out that data transmission on the internet (e.g., when communicating by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible.

Note on the Responsible Party

The responsible party for data processing on this website is:

AYA LATIN DANCE ACADEMY GbR
Rosastraße 9
79098 Freiburg

Represented by the partners: Anne Böhm, Anichi Bauer

Phone: +49 (0)176-63132283
E-mail: info@aya-dance.de

The responsible party is the natural or legal person who alone or jointly with others decides on the purposes and means of the processing of personal data (e.g., names, e-mail addresses, etc.).

Storage Duration

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for deletion or revoke consent, your data will be deleted, provided we have no other legally permissible reasons for storage (e.g., tax or commercial law retention periods); in the latter case, deletion takes place after these reasons no longer apply.

General Information on the Legal Basis

If you have consented to data processing, we process your data on the basis of Art. 6 para. 1 lit. a GDPR. If you have consented to the storage of cookies or to access to information in your terminal device (e.g., device fingerprinting), the data processing is additionally based on § 25 para. 1 TDDDG (Telecommunications-Digital-Services-Data-Protection-Act). Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 para. 1 lit. b GDPR. Furthermore, we process your data if it is necessary to fulfill a legal obligation on the basis of Art. 6 para. 1 lit. c GDPR. Data processing may also take place on the basis of our legitimate interest according to Art. 6 para. 1 lit. f GDPR. Information about the relevant legal basis in each individual case is provided in the following paragraphs.

Recipients of Personal Data

As part of our activities, we work with various external bodies (e.g., hosts, payment service providers). In some cases, a transfer of personal data is also necessary. We only pass on data if this is necessary within the framework of fulfilling a contract, if we are legally obliged to do so, if we have a legitimate interest in the transfer, or if another legal basis (e.g., your consent) exists. When using processors, we only pass on data on the basis of a valid data processing agreement.

Note on Data Transfer to Third Countries, especially the USA

We use, among other things, tools from companies based in third countries outside the EU or EEA, especially in the USA, or from companies whose parent companies are based there. When these tools are active, your personal data may be transferred to these countries and processed there.

For the USA, the European Commission issued an adequacy decision for the EU-US Data Privacy Framework (DPF) on July 10, 2023. Companies certified under the DPF guarantee an adequate level of data protection (Art. 45 GDPR). If a provider is not certified, the transfer takes place on the basis of standard contractual clauses of the EU Commission (Art. 46 para. 2 lit. c GDPR). We point out that US authorities (e.g., intelligence services) may be able to access your data without you being able to take effective legal action against this in the USA. Information on certifications can be found at https://www.dataprivacyframework.gov/.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke consent already given at any time with effect for the future. An informal notification by e-mail to us is sufficient for this. Consents that you have given via our cookie banner can also be changed or revoked at any time via the [LINK/BUTTON “Cookie Settings”]. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

If the data processing is based on Art. 6 para. 1 lit. e or f GDPR, you have the right at any time to object to the processing of your personal data for reasons arising from your particular situation; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for the processing that outweigh your interests, rights, and freedoms, or the processing serves the assertion, exercise, or defense of legal claims (objection according to Art. 21 para. 1 GDPR).

If your personal data is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising; this also applies to profiling, insofar as it is associated with such direct marketing. If you object, your personal data will subsequently no longer be used for the purpose of direct marketing (objection according to Art. 21 Para. 2 GDPR).

Right of Appeal to the Competent Supervisory Authority

In the event of violations of the GDPR, the data subjects have a right of appeal to a supervisory authority, in particular in the member state of their habitual residence, their place of work, or the place of the alleged violation. The right of appeal exists without prejudice to other administrative or judicial remedies.

The supervisory authority responsible for us is:
The State Commissioner for Data Protection and Freedom of Information Baden-Württemberg
Lautenschlagerstraße 20, 70173 Stuttgart
https://www.baden-wuerttemberg.datenschutz.de

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done insofar as it is technically feasible.

Information, Correction, and Deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient, and the purpose of the data processing (Art. 15 GDPR) and, if applicable, a right to correction (Art. 16 GDPR) or deletion (Art. 17 GDPR) of this data. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data (Art. 18 GDPR). For this purpose, you can contact us at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the audit, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection according to Art. 21 Para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise, or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL or TLS Encryption

For security reasons and to protect the transmission of confidential content, such as bookings or inquiries that you send to us, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line. If encryption is activated, the data you transmit to us cannot be read by third parties.

4. Data Collection on This Website

Cookies and Consent Management

Our internet pages use so-called “cookies”. Cookies are small data packets that are stored on your terminal device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit. Permanent cookies remain stored until you delete them yourself or an automatic deletion is carried out by your web browser.

Cookies that are technically necessary to provide the website or certain functions you desire (e.g., booking or shopping cart function, storage of your cookie selection) are stored on the basis of § 25 para. 2 no. 2 TDDDG and Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in the technically error-free and optimized provision of our services. All other cookies and comparable technologies (e.g., for analysis or marketing purposes) are only used with your consent (§ 25 para. 1 TDDDG, Art. 6 para. 1 lit. a GDPR). Consent can be revoked at any time.

To obtain and manage your consents, we use the consent tool [NAME, e.g., Borlabs Cookie / Complianz / Real Cookie Banner], provider: [PROVIDER, ADDRESS]. Your consent decision, an anonymized identifier, and the time of granting are stored in a cookie in your browser [and, if applicable, on our server] in order to be able to prove the consent (Art. 6 para. 1 lit. c GDPR in conjunction with Art. 7 para. 1 GDPR). The data will be deleted as soon as you request us to delete it, delete the cookie yourself, or the purpose for storage no longer applies; the cookie has a term of [12] months.

You can also set your browser so that you are informed about the setting of cookies, allow cookies only in individual cases, or exclude them generally. If cookies are deactivated, the functionality of this website may be restricted.

Server Log Files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

A merging of this data with other data sources is not carried out. The collection of this data is based on Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in the technically error-free presentation and optimization of our website as well as in the defense against attacks – for this purpose, the server log files must be recorded. The log files are deleted after [7 / 14 / 30] days.

Contact Form and Inquiry by E-mail or Telephone

If you contact us via contact form, e-mail, or telephone, your details including the contact data you provided will be stored and processed by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing takes place on the basis of Art. 6 para. 1 lit. b GDPR, provided your inquiry is related to the fulfillment of a contract or is necessary for the implementation of pre-contractual measures (e.g., questions about courses). In all other cases, the processing is based on our legitimate interest in the effective processing of the inquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR), if this was requested.

The data you transmit will remain with us until you request us to delete it, revoke your consent, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Registration on This Website

You can register on our website or create a customer account to use additional functions (e.g., insight into your bookings and orders, faster ordering). We use the data entered for this purpose only for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full, otherwise we cannot carry out the registration.

For important changes, such as in the scope of the offer or in the case of technically necessary changes, we use the e-mail address provided during registration to inform you in this way.

The processing of the data entered during registration takes place for the purpose of implementing the user relationship established by the registration and, if applicable, for the initiation of further contracts (Art. 6 para. 1 lit. b GDPR).

The data collected during registration will be stored by us as long as you are registered on this website and will then be deleted. Statutory retention periods remain unaffected.

Processing of Customer and Contract Data

We collect, process, and use personal data only insofar as it is necessary for the establishment, content design, or modification of the legal relationship (e.g., course booking, membership) (inventory data). This is done on the basis of Art. 6 para. 1 lit. b GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process, and use personal data about the use of this website (usage data) only insofar as this is necessary to enable you to use the service or to bill you.

The collected customer data will be deleted after completion of the order or termination of the business relationship and expiry of any existing statutory retention periods (usually 6 or 10 years according to HGB/AO).

Data Transfer upon Conclusion of Contract for Services

We transfer personal data to third parties only if this is necessary within the framework of contract processing, for example to the credit institution commissioned with payment processing or the selected payment service provider. A further transfer of the data does not take place or only if you have expressly agreed to the transfer. A transfer of your data to third parties without express consent, for example for advertising purposes, does not take place.

The basis for data processing is Art. 6 para. 1 lit. b GDPR.

5. Social Media

Facebook Plugins (Like & Share Button)

Elements of the social network Facebook are integrated on this website. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. According to Meta, however, the collected data is also transferred to the USA and other third countries. An overview of the Facebook social media elements can be found here: https://developers.facebook.com/docs/plugins/.

The plugins are only loaded once you have given your consent via our cookie banner. If this is the case, a direct connection is established between your terminal device and the Facebook server. Facebook thereby receives the information that you have visited this website with your IP address. If you click the Facebook “Like Button” while you are logged into your Facebook account, you can link the content of this website to your Facebook profile. This allows Facebook to assign the visit to this website to your user account. We point out that we, as the provider of the pages, receive no knowledge of the content of the transmitted data or its use by Facebook. Further information on this can be found in Meta’s privacy policy at: https://www.facebook.com/privacy/policy/.

The use is based on your consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG). Consent can be revoked at any time.

Insofar as personal data is collected on our website and forwarded to Facebook with the help of the tool described here, we and Meta Platforms Ireland Limited are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its transfer to Facebook. The processing by Facebook that takes place after the transfer is not part of the joint responsibility. The obligations incumbent on us jointly were set out in an agreement on joint processing: https://www.facebook.com/legal/controller_addendum. According to this agreement, Facebook is responsible for providing data protection information when using the Facebook tool and for the data protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of Facebook products. You can assert data subject rights regarding the data processed by Facebook directly with Facebook.

The company has certification according to the EU-US Data Privacy Framework (DPF).

The provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. We are jointly responsible with Meta for the creation of Page Insights (Art. 26 GDPR); the agreement can be found at https://www.facebook.com/legal/terms/page_controller_addendum. The legal basis is our legitimate interest in modern public relations work (Art. 6 para. 1 lit. f GDPR). You can assert your data subject rights both with us and directly with Meta.

StudioBook processes this data on our behalf (Art. 28 GDPR, data processing agreement). The database is located in the EU (Frankfurt). StudioBook uses additional service providers for sending booking emails and processing payments, some of which are based in the USA. You can find the list at studiobook.app/legal/dpa. The legal basis is Art. 6 (1) (b) GDPR.

E-mails regarding the order
In connection with your order, you will automatically receive confirmation and status e-mails (e.g., order receipt, payment confirmation, invoice). These are necessary for contract processing (Art. 6 para. 1 lit. b GDPR). We only send promotional e-mails with your separate consent.

7. Plugins and Tools

Google Analytics

This website uses – provided you have consented to this – functions of the web analysis service Google Analytics (Google Analytics 4). The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).

Google Analytics enables us to analyze the behavior of website visitors. In doing so, we receive various usage data, such as page views, duration of stay, operating systems used, approximate origin (country/city) of the user, and interactions on the page (e.g., clicks, scrolling, downloads). This data is assigned to a pseudonymous user or device identifier. Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting).

IP Addresses
In Google Analytics 4, IP addresses are not logged or stored. For access from the EU, the IP address is only used briefly on servers in the EU to derive location data and then immediately discarded.

Legal Basis and Revocation
The use of this service takes place exclusively on the basis of your consent according to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Google Analytics is only loaded after you have given your consent via our cookie banner. If you are logged into your Google account and have allowed personalized advertising, Google can evaluate your usage data across devices and link it to your Google account.

Storage duration
Data at the user and event level linked to cookies or user identifiers is automatically deleted after [2 / 14] months. Google Analytics cookies (e.g., “_ga”, “_ga_”) have a lifespan of up to 2 years. Details can be found at: https://support.google.com/analytics/answer/7667196?hl=en.

As soon as you load a video, a connection to YouTube’s servers is established. YouTube is thereby informed which of our pages you have visited and your IP address is transmitted. Even in extended data protection mode, YouTube can store information on your terminal device (e.g., cookies, local storage) and establish connections to the Google advertising network (DoubleClick), especially after starting a video.
